MEMBERS PROGRAM — TERMS OF USE
Effective Date: March 1, 2026
These Members Terms of Use (the “Terms”) govern participation in the Bomber LD USA Inc. membership program (the “Program”) offered by: Bomber LD USA Inc. USA Inc., a Nevada corporation (“Bomber LD USA Inc.,” “Company,” “we,” “us,” or “our”).
By enrolling in or participating in the Program, you agree to these Terms and the Company’s:

If you do not agree, you may not participate in the Program
1. ELIGIBILITY
To enroll, you must:
• Be at least 18 years of age or the age of majority in your jurisdiction
• Provide accurate and complete account information
• Maintain an active customer account on bomberld.com
The Program is intended for customers located within the United States.
2. FREE MEMBERSHIP
The Program is offered free of charge.
• No membership fees
• No recurring billing
• No payment required to join
Bomber LD USA Inc. reserves the right to introduce paid tiers, premium features, or subscription-based benefits in the future.
3. MARKETING COMMUNICATIONS (CONDITION OF MEMBERSHIP)
Participation in the Program requires consent to receive marketing and promotional communications from Bomber LD USA Inc..
Members may withdraw consent at any time; however, such withdrawal will result in the loss of membership benefits. The underlying customer account will remain active.
Bomber LD USA Inc. reserves the right to condition Program eligibility on ongoing communication consent, to the extent permitted by applicable law
4. COMMUNICATIONS DISCLOSURE (CAN-SPAM & TCPA)
By enrolling in the Program, you agree that Bomber LD USA Inc. may send you:
• Marketing and promotional emails
• Transactional and account-related communications
If you provide a mobile number and opt in:
• You may receive SMS/text messages
• Message frequency may vary
• Standard message and data rates may apply
You may opt out at any time by:
• Using unsubscribe links (email)
• Replying STOP (SMS)
Consent to receive marketing communications is not a condition of purchase, but is a condition of membership benefits.

7. ACCOUNT RESPONSIBILITY

Violation may result in suspension or termination.
9. TERMINATION & SUSPENSION
Bomber LD USA Inc. may:
• Suspend or terminate membership
• Revoke benefits at any time
• Cancel associated orders where necessary
Grounds include:
Fraud or abuse
• Violation of these Terms
• Operational or legal risk
10. MODIFICATIONS TO PROGRAM
Bomber LD USA Inc. may:
• Modify or discontinue the Program
• Change eligibility, structure, or benefits
• Introduce new membership tiers
Continued participation constitutes acceptance of updates.
11. NO WARRANTIES
The Program is provided on an:
• “AS IS”
• “AS AVAILABLE”
basis without warranties of any kind.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
Bomber LD USA Inc. shall not be liable for:
• Indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions or benefit unavailability
Total liability shall not exceed $100 USD.
13. ARBITRATION AGREEMENT & CLASS ACTION WAIVER
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to the Program shall be resolved by binding arbitration, rather than in court
No Class Actions
You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Arbitration Rules
Arbitration shall be administered by a recognized arbitration provider (e.g., AAA) under its applicable rules.
Exceptions
Nothing prevents either party from seeking:
• Small claims court relief (where eligible)
• Injunctive or equitable relief for intellectual property or misuse
14. GOVERNING LAW
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
15. PRIVACY
Participation in the Program is subject to the Privacy Policy. Personal information is used for:
• Membership administration
• Order fulfillment
• Marketing and personalization
16. ENTIRE AGREEMENT
These Terms constitute the entire agreement regarding the Program.
17. SEVERABILITY
If any provision is found unenforceable, the remaining provisions remain in full force.
